My faith in humanity is fading away and this process has been accelerated by the fact that Sony has been granted the restraining order against Geohot and the Fail0verflow team. The US District Court for the Northern District of California decided that Sony is right meaning that GeoHot and Fail0verflow cannot distribute the PS3 jailbreak method any longer, and in addition, they cannot encourage users to jailbreak their PS3.

Anyway Sony didn’t win anything yet because other people can still distribute and promote jailbreaking, and I’ve noticed that they won’t stop, and I doubt that Sony will sue thousands of people. The good thing is that jailbreaking is not illegal therefore we can continue to do the aforementioned stuff for as long as we want.

What I don’t understand, is how did Sony win this complaint. Like said: jailbreaking is not illegal so why would the US District Court for the Northern District of California grant a restraining order against Mr. George Hotz and Fail0verflow? More on this matter can be read here.

Congratulations Sony! You’ve turned me and a lot of other people into lifetime haters! Yesterday I’ve said in a post that Sony is a very bad loser and now the company has proved it. Although initially Sony filed for a restraining order against George Hotz and the Fail0verflow team, now the gaming company has filed suit against them due to violations of the Digital Millennium Copyright Act.

Sony says that these guys have violated the Computer Fraud and Abuse Act which says that nobody is allowed to access a computer if they don’t have an authorization. However I am deeply sure that the US Government has ruled that the iPhone jailbreak is legal and I don’t see why the PS3 jailbreak would be illegal.

Sony’s complaint also says that George Hotz, Sven Peter, and Hector Martin Cantero have helped, allowed, and encouraged others to hack the PS3. Other Sony claims say that GeoHot and Fail0verflow have violated the California Computer Crime Law, the PlayStation Network TOS, Sony Intellectual Property, and other stupid stuff like interfering with Sony PSN users and trespassing PS3 ownership rights.

Oh Sony, I feel sorry for you, but if the US Constitution will be respected, then you’re going to lose this badly. I will never buy a Sony product. Never ever. I can’t understand the company’s decision to sue GeoHot and the Fail0verflow squad.

Sony is the sorest loser of all time and the company is going down. After Sony Ericsson went down, Sony itself is going down being overtaken by Microsoft and Nintendo. I have to admit that I’m very pleased with this and the latest event proves that I’m right. Sony has decided to take legal action against GeoHot and the Fail0verflow team which released the PS3 jailbreak.

Sony says that GeoHot and the Fail0verflow team have violated the Digital Millennium Copyright Act, and The Computer Fraud and Abuse Act. Also GeoHot and Fail0verflow has violated a lot of copyright infringements and Sony wants a restraining order against George Hotz and Fail0verflow’s Sven Peter, Hector Cantero, Segher, and Busher.

The company is bothered that these guys have managed to jailbreak the PS3 and it wants all the PS3 jailbreak data to be taken down. Well, I don’t think Sony will win this because it violates human rights. Sony, have you ever heard of “freedom of speech”? Also another court has ruled that the iPhone jailbreak is legal so I don’t see any reasons why the PS3 jailbreak wouldn’t be legal. Read more on that here.

GeoHot is on a high note once again as he has just released a PS3 jailbreak tool for 3.55 firmware. George Hotz already released the PS3 hack codes last week and he had also demoed how you can install homebrew firmware on the popular PS3. Well, like said, your waiting is now over as you can download GeoHot’s custom firmware for the PS3 and probably some other cool stuff.

Mr. Hotz once again states that he doesn’t encourage piracy and that he’s trying to make the PS3 more secure. Sony says that this hole will be fixed with a firmware upgrade, but who’s going to keep GeoHot from cracking it again?
